At 7:15 p.m. tomorrow, the Avon Planning Commission will hold a public hearing on a rezoning request for property located at 36053 Detroit Road.
The commission will then vote on the rezoning during a regular meeting to begin at 7:30 p.m. in Council Chambers.
Action would change the property zoning from R-2 residential to C-2 commercial French Creek District.
The approximately .65-acre property, located just west of the former Avon Lake Motor Sales car lot on the southwest corner of SR 83 and Detroit Road, was previously owned by BP Products North America. According to the Lorain County Auditor real estate transfers, in November 2009, 36019 Detroit Road Avon LLC purchased the land. The LLC also owns the former car lot property at 36019 Detroit Road, which is approximately .18 acres and .36 acres to the south of the car lot along SR 83. Both of those parcels were also purchased from BP.
When BP announced it was selling the three parcels last June, Avon Planning Coordinator Jim Piazza explained to The Press the history of BP with the city.
In 1999, the company came before Avon Planning Commission requesting permission to build a gas station on that corner.
“At that time, it was called C-2 (general commercial),” Piazza said of the zoning. “C-4 was motor service. This was before French Creek was part of C-2.”
French Creek zoning does not allow for filling stations.
The Planning Commission recommended to council approval of the station at that time. Piazza said council denied the request.
BP took the issue to court.
“We won the local court decision, and BP appealed to the court of appeals,” Piazza said, adding the appeal ruling was in favor of the city as well.
The contact person listed for the 36019 Detroit Road Avon LLC is Barb Gulyas of Lehigh Gas Corporation, who could not be reached for comment prior to The Press deadline.
